Welcome to Vincere Bikinis. These Terms and Conditions govern your use of www.vincerebikinis.shop and www.vincerebikinis.com (together, the “Website”) and any purchase you make from us. The Website is operated by Vincere Bikinis, a sole proprietorship registered in Ontario, Canada, and based in Toronto (“Vincere Bikinis”, “we”, “us”, or “our”). By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website.

1. Eligibility

To place an order, you must be at least the age of majority in your province or territory of residence, or be using the Website with the involvement and consent of a parent or legal guardian. You agree that the information you provide to us is accurate, current, and complete.

2. Products

We make every effort to display our products, colours, and details as accurately as possible. Because screens display colour differently, we cannot guarantee that your screen will show the exact colour of a product. Every Vincere release is produced in a limited run, so all products are subject to availability. We reserve the right to limit quantities, discontinue a product, or change product details at any time without notice.

3. Pricing and Payment

All prices are listed in Canadian dollars. Prices may change without notice, but a change will not affect an order that we have already confirmed. Any applicable taxes and shipping charges are calculated and displayed at checkout before you place your order. Payments are processed securely through our online store platform and its payment processors, and we do not store your full payment card details. If a product is listed at an incorrect price because of a typographical or system error, we reserve the right to cancel any order placed at that price and issue a full refund.

4. Orders

Your order is an offer to purchase. After you place an order, you will receive an email confirming that we have received it. This confirmation does not mean that your order has been accepted. Your order is accepted when it ships. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, errors in product or pricing information, or limited availability. If we cancel an order after payment has been processed, we will issue a full refund to your original payment method.

5. Shipping

We currently ship within Canada only. Shipping rates, processing times, and delivery estimates are described in our Shipping Policy, which forms part of these Terms and Conditions. Delivery dates are estimates and are not guaranteed.

6. Cancellations, Exchanges, and Refunds

For hygiene reasons, all sales are final once an order has shipped, and we do not offer refunds or exchanges on shipped orders, including size exchanges. You may cancel an order for a full refund, or change your size (subject to availability), before it ships. Full details are set out in our Refund Policy, which forms part of these Terms and Conditions.

7. Product Care

Please follow the care instructions provided with each product. We are not responsible for damage caused by improper care, misuse, alterations, or normal wear over time.

8. Intellectual Property

All content on the Website, including the Vincere Bikinis name, the V logo, product designs, photographs, videos, graphics, and text, is owned by Vincere Bikinis or used with permission, and is protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, modify, or use any content from the Website for commercial purposes without our prior written permission.

9. Your Submissions

If you send us comments, reviews, photos, or other material, including by tagging us on social media, you confirm that you have the right to share that material and that it does not violate the rights of any other person. We will ask for your permission before featuring your content on the Website or our social media channels.

10. Acceptable Use

You agree not to use the Website for any unlawful purpose, interfere with its security or operation, attempt to gain unauthorized access to any account, system, or data, submit false information or fraudulent orders, or copy content from the Website by automated means.

The Website is hosted on the Wix platform, and payment, shipping, and other services are provided by third parties, including Canada Post. The Website may also link to third party websites and social media platforms. We are not responsible for the content, policies, or practices of any third party, and your use of their services is subject to their own terms.

The Website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms and Conditions. Nothing in these Terms and Conditions excludes or limits any warranty, condition, or right that cannot be excluded or limited under applicable consumer protection law.

13. Limitation of Liability

To the fullest extent permitted by law, Vincere Bikinis will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

You agree to indemnify and hold harmless Vincere Bikinis from any claims, losses, or expenses, including reasonable legal fees, arising from your breach of these Terms and Conditions or your misuse of the Website.
